Palestine and International Law, New Approaches

In 2010, the Institute of Law at Birzeit University issued “Palestine and International Law, New Approaches” which contained the proceedings of a conference held at Birzeit University on 24-26 September 2010. The book is divided into four main sections; i) Civilians in Asymmetrical Warfare, the Israeli Palestinian Pattern; ii) Transformative Occupation and Annexation, a Theoretical and Practical Perspective iii) Secondary Norms of the Law of State Responsibility in the Israeli Palestinian conflict iv) The Law of individual Responsibility and the Israeli-Palestinian Conflict.

In the foreword of the paper, Jean-Philippe Kot raises different questions regarding international law and Palestine; Kot further presents various approaches to be used for international legal history. Such approaches contain both, the contextualized approach and the formalist approach. However, according to Kot, it is better to use the contextualized approach in order for one to understand the past. Moreover, in the prolegomenon of the paper written by Victor Kattan, under “International law and the Origins of the Israel-Palestine Conflict, New Approaches, New Findings,” Kattan uses the contextualized approach in writing the history of the Israeli-Palestininian conflict.

The first section of the proceedings “Civilians in Asymmetrical Warfare, the Israeli Palestinian Pattern” contains three papers; i) Disproportionality and Deterrence: “The Dahiya Doctrine” under International Law, by Omar Dajani and Nicholas Gibson; ii) Duty to spare Civilians vs. Duty to Protect Soldiers’ Lives: an Examination of the Kasher and Yadlin Doctrine by Jean Philippe Kot; and iii) Qualifier en droit, disqualifier en fait ? Analyse critique du discours de l'Union européenne sur l'usage de la violence dans le conflit israélo-palestinien by Barbara Delcourt.

The second section of the proceedings includes three research papers related to transformative occupation and annexation, as follows; i) The Challenges Faced by Legal Practitioners Before Israeli courts, Facts and Figures by Antonia Mulvay; ii) The Case of Shaikh Jarrah- East- Jerusalem by Hadeel Abo Hussein, iii) Du Droit Humanitaire  au droit de l’homme des colons, Moussa Abu Ramadan.

The third section of the proceedings under the title “Secondary Norms of the Law of State Responsibility in the Israeli Palestinian conflict” includes the following papers; i) L’applicibilite du droit de legitime defense dans  le rapports entre Israeli et le Territoire palestinien occupe, francois dubuisson ii) Les faiblesses du droit de la responsabilite au Coeur des defaillances du droit international en Palestine, Monique Chenillier –Gendreau; iii) Recalibrating Secondary Rules of State Responsibility Through Primary Rules of conduct: A Battle of Symbols? By Jean D’Aspremont.

The last section of the proceedings discusses “The Law of individual Responsibility and the Israeli-Palestinian Conflict” and includes the following papers : i) Palestine and the International Criminal Court by Michael Kearney ii) The Responsibility of Senior Leaders and Military Commanders and the Recourse to the Principle of Universal Jurisdiction by Chantal Meloni iii) The Duty of Non-Recognition of Unlawful Situations in the Palestinian Context: What Effects for Private Businesses ? By Herve Ascensio.
