Legislation Pertaining to Planning and Construction in Palestine; Presentation, Classification and Analysis

The paper of “Legislation Pertaining to Planning and Construction in Palestine; Presentation, Classification and Analysis” is a paper written by Usama Halabi, and complied by Mousa Abu Dheim. This paper was prepared as part of a series of legal studies in the center of Law at Birzeit University, and sponsored by Ministry of Planning and International cooperation. The paper was written in an attempt to facilitate access to the laws and regulations pertaining to planning and construction in force in the Palestinian territories occupied in 1967, and to contribute to the formulation of a unified legal system in Palestine.

In the first chapter, the article lists the laws, regulations and the orders concerning planning and construction in Palestine from 1921 and until 1994. It references laws and regulations during the British Mandate, laws and regulations issued or in practice during the Jordanian Rule, the period of Egyptian Administration, Israeli Military Orders, legislation promulgated by the Palestinian National Authority, and Palestinian-Israeli agreements. The second chapter consists of two parts; each part discusses the administrative structure of the planning authority and their jurisdiction pursuant to town planning ordinance, planning schemes, construction licenses and building permits, and public participation in the planning process and representation in the planning commissions for the West Bank and the Gaza Strip. The third chapter contains remarks and suggestions that aim at developing an improved and unified planning and construction law in Palestine.
